Ці Умови — договір між вами та оператором сервісу Blockchain-Certificate (далі — «Сервіс», «ми»). Оператор: ФОП Руденко Павло Вікторович, реєстраційний номер 3353315156, адреса: вул. Бойченка, 18, м. Миколаїв, Україна. Електронна пошта: mail@blockchain-certificate.com.
Користуючись Сервісом або оплачуючи сертифікат, ви погоджуєтеся з цими Умовами. Якщо ви не згодні, не користуйтеся Сервісом.
2. Що робить Сервіс
Ви обираєте файл. Ваш браузер обчислює його криптографічний відбиток (хеш SHA-256) на вашому пристрої. Сам файл нам не передається і в нас не зберігається.
Після оплати або списання сертифіката з балансу ми записуємо хеш у блокчейн Ethereum і видаємо сертифікат із даними, які ви вказали, хешем, номером транзакції та QR-кодом із посиланням на неї. Сертифікат надсилається на вказану вами електронну пошту.
3. Що сертифікат підтверджує, а що ні
Сертифікат підтверджує, що файл із таким хешем існував не пізніше часу блоку, у якому зроблено запис, і що особа, яка замовила запис, мала цей файл.
Сертифікат не є державною реєстрацією авторського права, патентом, нотаріальним документом чи юридичним висновком. Він не підтверджує сам по собі, що саме ви створили файл, і не гарантує, що суд або інша установа прийме його як доказ. Ми не надаємо юридичних послуг.
Сервіс не продає криптовалюту, токени чи NFT. Ви не отримуєте жодного цифрового активу: блокчейн використовується лише як публічний реєстр із позначкою часу.
4. Запис неможливо змінити
Запис у блокчейні публічний і постійний. Після створення його не можемо змінити чи видалити ні ви, ні ми. Перед оплатою перевірте, що обрали правильний файл і правильно вказали автора та назву.
У блокчейн записується лише хеш. Ім'я, назва та електронна пошта туди не потрапляють.
5. Ваші обов'язки
Ви підтверджуєте, що маєте право на файл, який реєструєте, і що вказані вами дані правдиві. Заборонено видавати чужі роботи за свої та вказувати чужі імена без дозволу.
Зберігайте оригінальний файл і сертифікат у незмінному вигляді. Якщо файл втрачено або змінено хоча б на один біт, сертифікат уже не можна буде з ним зіставити, а відновити файл із хешу неможливо. Відповідальність за збереження оригіналу несете ви.
Користуватися Сервісом можуть особи, які досягли 18 років, або молодші за згодою батьків чи опікунів.
6. Кабінет
Один сертифікат можна придбати без реєстрації. Щоб купувати пакети та зберігати сертифікати в одному місці, потрібен кабінет: ім'я, електронна пошта й пароль або вхід через Google.
Ви відповідаєте за збереження пароля та за дії у своєму кабінеті. Кабінет можна видалити, написавши нам. Невикористані сертифікати при видаленні кабінету втрачаються; записи в блокчейні та вже видані сертифікати залишаються чинними.
7. Ціни та оплата
Чинні ціни вказано на сторінці «Ціни». Один сертифікат — це один запис одного файлу в блокчейн. Придбані сертифікати не згорають і зберігаються у вашому кабінеті, доки ви їх не використаєте або не видалите кабінет.
Оплату приймає Creem (creem.io) як офіційний продавець (Merchant of Record): саме Creem є продавцем у платіжній операції, нараховує податки, видає квитанцію і може бути вказаний у виписці вашого банку. Ми не отримуємо і не зберігаємо дані вашої картки.
Ціни можуть змінюватися. Зміна не стосується вже оплачених сертифікатів.
8. Повернення коштів
Умови повернення описано в окремому документі «Повернення коштів», який є частиною цих Умов.
9. Доступність
Ми намагаємося, щоб Сервіс працював безперебійно, але не гарантуємо цього. Запис залежить від мережі Ethereum і може затримуватися через її завантаженість. Якщо запис не вдалося зробити, ми повторимо його або повернемо сертифікат на баланс чи кошти.
Etherscan та інші оглядачі блокчейну — сторонні сайти, за їхню роботу ми не відповідаємо. Запис у блокчейні існує незалежно від них і від нашого Сервісу.
10. Обмеження відповідальності
У межах, дозволених законом, ми не відповідаємо за непрямі збитки, втрачену вигоду, результат спорів про авторство, а також за наслідки втрати чи зміни вашого оригінального файлу. Наша сукупна відповідальність обмежена сумою, яку ви сплатили за Сервіс протягом 12 місяців до події.
Це не обмежує прав, які надає вам як споживачеві обов'язкове законодавство вашої країни.
11. Наші права на Сервіс
Назва, дизайн, тексти й програмний код Сервісу належать оператору. Права на ваші файли залишаються вашими: ми не отримуємо ні файлів, ні прав на них.
12. Зміни, право та спори
Ми можемо оновлювати ці Умови. Нова редакція публікується на цій сторінці з датою; про суттєві зміни ми повідомимо користувачів кабінетів електронною поштою.
До цих Умов застосовується право України. Спори спершу вирішуються листуванням із підтримкою, а якщо згоди не досягнуто — у судах України. Споживачі зберігають права, надані обов'язковими нормами країни їхнього проживання.
Документи викладено українською та англійською. У разі розбіжностей перевагу має українська версія.

1. About this document
These Terms are an agreement between you and the operator of the Blockchain-Certificate service (the “Service”, “we”). Operator: Rudenko Pavlo Viktorovych, individual entrepreneur (FOP), registration number 3353315156, address: 18 Boichenka St, Mykolaiv, Ukraine. Email: mail@blockchain-certificate.com.
By using the Service or paying for a certificate you accept these Terms. If you do not agree, do not use the Service.
2. What the Service does
You choose a file. Your browser calculates its cryptographic fingerprint (a SHA-256 hash) on your device. The file itself is not sent to us and is not stored by us.
After payment, or after a certificate is taken from your balance, we write the hash to the Ethereum blockchain and issue a certificate with the details you entered, the hash, the transaction number and a QR code linking to it. The certificate is sent to the email address you provide.
3. What a certificate confirms and what it does not
A certificate confirms that a file with this hash existed no later than the time of the block containing the record, and that the person who ordered the record had that file.
A certificate is not a state copyright registration, a patent, a notarised document or legal advice. It does not by itself confirm that you created the file, and we do not guarantee that a court or any other body will accept it as evidence. We do not provide legal services.
The Service does not sell cryptocurrency, tokens or NFTs. You receive no digital asset: the blockchain is used only as a public, time-stamped register.
4. A record cannot be changed
A blockchain record is public and permanent. Once created, it cannot be changed or deleted by you or by us. Before paying, check that you chose the right file and entered the author and title correctly.
Only the hash is written to the blockchain. Your name, the title and your email are not.
5. Your responsibilities
You confirm that you have the right to the file you register and that the details you enter are true. You must not present other people's work as your own or use other people's names without permission.
Keep the original file and the certificate unchanged. If the file is lost or altered by even one bit, the certificate can no longer be matched to it, and a file cannot be recovered from a hash. Keeping the original is your responsibility.
You may use the Service if you are 18 or older, or younger with the consent of a parent or guardian.
6. Account
One certificate can be bought without registration. To buy packs and keep your certificates in one place you need an account: a name, an email and a password, or sign-in with Google.
You are responsible for keeping your password safe and for activity in your account. You can delete your account by writing to us. Unused certificates are lost when an account is deleted; blockchain records and certificates already issued remain valid.
7. Prices and payment
Current prices are shown on the Pricing page. One certificate is one record of one file in the blockchain. Purchased certificates do not expire and stay in your account until you use them or delete the account.
Payments are processed by Creem (creem.io) as Merchant of Record: Creem is the seller in the payment transaction, calculates taxes, issues the receipt and may appear on your bank statement. We do not receive or store your card details.
Prices may change. A change does not affect certificates already paid for.
8. Refunds
Refund terms are set out in the separate Refund policy, which forms part of these Terms.
9. Availability
We aim to keep the Service running without interruption but do not guarantee it. A record depends on the Ethereum network and may be delayed when the network is busy. If a record cannot be made, we will retry it, or return the certificate to your balance, or refund you.
Etherscan and other blockchain explorers are third-party sites and we are not responsible for them. The blockchain record exists independently of them and of our Service.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect loss, loss of profit, the outcome of authorship disputes, or the consequences of losing or altering your original file. Our total liability is limited to the amount you paid for the Service in the 12 months before the event.
This does not limit rights you have as a consumer under the mandatory law of your country.
11. Our rights in the Service
The name, design, texts and software of the Service belong to the operator. Rights in your files remain yours: we receive neither the files nor any rights in them.
12. Changes, law and disputes
We may update these Terms. The new version is published on this page with its date; we will email account holders about material changes.
These Terms are governed by the law of Ukraine. Disputes are first handled by correspondence with support and, failing agreement, by the courts of Ukraine. Consumers keep the rights given by the mandatory rules of their country of residence.
The documents are written in Ukrainian and English. If they differ, the Ukrainian version prevails.
